Membership Terms

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY SUBMITTING THIS FORM, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. THESE TERMS AND CONDITIONS ARE SUBJECT TO CHANGE WITHOUT NOTICE, FROM TIME TO TIME IN THE SOLE DISCRETION OF THE INDIAN TRAIL BUSINESS ASSOCIATION (ITBA). THE ITBA WILL NOTIFY YOU OF AMENDMENTS TO THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PLEASE DO NOT SUBMIT THIS FORM.

I understand that membership in the ITBA is voluntary, and that I am free to terminate my membership at any time through a written request to the ITBA. I agree that the ITBA has permission to communicate with me or my business on matters concerning the ITBA or its mission. I agree that the ITBA may publish contact information for my business in publications or on its website, and I have the right to revoke this permission (resulting in the removal of contact information for my business in future publications or on the website) at any time through a written request to the ITBA. I understand that membership in the ITBA is a privilege and not a right, and as a member, I agree to support the ITBA and its mission. I understand that membership in the ITBA may be revoked at the discretion of its Board for activities which promote dissension or subversion or frustrate the purpose of the ITBA and its mission.

Membership is provided "as is." The ITBA, its affiliates, and any third party providers: (i) are not providing any warranties and representations regarding membership; (ii) disclaim all warranties and representations of any kind with regard to membership, including any implied warranties of merchantability, non-infringement of third party rights, or fitness for a particular purpose; and (iii) will not be liable for any issues relating to membership which are beyond the control of the ITBA. No license to any member is implied. Nothing herein shall be construed as limiting or reducing the responsibilities and obligations of the ITBA to its members in accordance with applicable laws and regulations.

UNDER NO CIRCUMSTANCES WILL THE ITBA BE LIABLE FOR ANY LOST PROFITS, LOST OPPORTUNITY OR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF MEMBERSHIP OR REFUSAL OF MEMBERSHIP, REGARDLESS OF WHETHER THE ITBA HAS BEEN APPRISED OF THE LIKELIHOOD OF SUCH DAMAGES OCCURRING AND REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE. IN ANY EVENT, DAMAGES SHALL BE LIMITED TO THE AMOUNT OF ANY MEMBERSHIP FEE PAID.

Ordering Information

Our recurring, monthly payments are processed by PayPal. If you choose to pay in twelve installments, once your form has been submitted, you will be forwarded to PayPal where you will then enter in your payment information. If you choose to pay in one installment by check, you will only need to submit the form to confirm your membership.
